Terms of Use

These Terms of Use (“Terms”) govern your access to and use of www.webxpress.ai (the “Site”) operated by ECFY Consulting Private Limited, a company incorporated in India with its registered office in Mumbai, Maharashtra (“WebXpress”, “we”, “us”, “our”). By accessing the Site or submitting information through it, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Use of the Site

You may use the Site for lawful business purposes only. You agree not to:

• use the Site in any way that breaches applicable laws or regulations;
• attempt to gain unauthorised access to the Site, its servers or any connected system;
• introduce viruses, worms or other malicious code;
• scrape, copy or redistribute Site content without written permission;
• misrepresent your identity or affiliation when submitting information.

2. Demo requests and sales enquiries

The Request a Demo form and similar contact forms are provided to help you evaluate WebXpress’s logistics software. By submitting a form you confirm that:

• the information you provide is accurate and relates to a genuine business enquiry;
• you are authorised to provide that information on behalf of the organisation named;
• you consent to WebXpress contacting you at the details provided to schedule a demo, share relevant product information and follow up on your enquiry;
• the Site and the demo do not constitute an offer to contract; any engagement is subject to a separate written agreement.

You may opt out of sales and marketing communications at any time by emailing business@webxpress.in with the subject line “Unsubscribe”, or by using any unsubscribe link provided in an email.

3. Intellectual property

All content on the Site — including text, graphics, logos, product screenshots, videos, case studies, documents and software — is owned by WebXpress or its licensors and is protected by Indian and international intellectual property laws. You are granted a limited, revocable, non-exclusive licence to view and download Site content for your internal business evaluation purposes only.

“WebXpress”, “GreenXpress”, the WebXpress logo and related marks are trademarks of ECFY Consulting Private Limited. You may not use them without prior written consent.

4. Third-party content and links

The Site may link to third-party websites, services or resources (for example, LinkedIn, YouTube or customer sites). WebXpress does not control and is not responsible for the content, accuracy or practices of those third parties. Your use of them is at your own risk and subject to their own terms.

5. Customer logos and testimonials

Customer names, logos and testimonials on the Site are used with permission of the respective organisations and are for informational purposes only. They do not imply endorsement of third-party products or services and are subject to change.

6. Disclaimers

The Site and all content are provided “as is” and “as available”, without warranties of any kind, whether express or implied, to the maximum extent permitted by law. WebXpress does not warrant that the Site will be uninterrupted, error-free, secure or free of harmful components, or that any information on the Site is complete, current or accurate.

Nothing on the Site constitutes legal, financial, tax or professional advice.

7. Limitation of liability

To the maximum extent permitted by law:

• WebXpress shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, data or business opportunities, arising out of or in connection with your use of the Site;
• WebXpress’s total aggregate liability arising out of or in connection with the Site and these Terms shall not exceed INR 10,000 (Indian Rupees ten thousand) or the equivalent in your local currency.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

8. Indemnification

You agree to indemnify, defend and hold harmless WebXpress, its directors, officers, employees and affiliates from any claim, loss, liability or expense (including reasonable legal fees) arising out of your breach of these Terms, misuse of the Site, or violation of any law or third-party right.

9. Privacy

Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use and protect personal data. By using the Site you acknowledge you have read the Privacy Policy.

10. Changes to the Site and Terms

WebXpress may modify, suspend or discontinue any part of the Site at any time without notice. We may also revise these Terms from time to time; the revised version will be posted on this page with a new “Last updated” date. Continued use of the Site after changes constitutes acceptance.

11. Governing law and jurisdiction

These Terms are governed by the laws of India. The courts at Mumbai, Maharashtra shall have exclusive jurisdiction over any dispute arising out of or in connection with the Site or these Terms, subject to your non-waivable consumer rights under applicable law.
